D&eacute;finition et formules<\/strong><\/h4>\n\n\n\n<p>La prime de participation aussi nomm&eacute;e la R&eacute;serve Sp&eacute;ciale de Participation, collective et obligatoire dans les entreprises de plus de 50 salari&eacute;s, correspond au partage des r&eacute;sultats de l&rsquo;entreprise avec l&rsquo;ensemble de ses salari&eacute;s. Toutefois, il peut &eacute;galement &ecirc;tre tr&egrave;s int&eacute;ressant de mettre en place, ce type d&rsquo;accord dans les entreprises de moins de 50 salari&eacute;s.<\/p>\n\n\n\n<figure class=\"wp-block-table aligncenter\"><table class=\"has-subtle-light-gray-background-color has-background\"><tbody><tr><td class=\"has-text-align-center\" data-align=\"center\">Sa formule l&eacute;gale est la suivante :<br><strong><a href=\"http:\/\/toutsavoirsurlepargnesalariale.fr\/pee\/index.php\/glossary\/calcul\/\" data-type=\"glossary\" data-id=\"454\">RSP = &frac12; (B &ndash; 5 % C) x S\/VA<\/a><\/strong><\/td><\/tr><\/tbody><\/table><\/figure><p>La premi&egrave;re partie de la formule <strong>&frac12; (B &ndash; 5 % C)<\/strong> consiste &agrave; reverser aux salari&eacute;s la moiti&eacute; des b&eacute;n&eacute;fices nets de l&rsquo;entreprise sauf 5% des capitaux propres de l&rsquo;entreprise afin qu&rsquo;elle puisse s&rsquo;auto-financer tandis que la deuxi&egrave;me partie de cette formule, <strong>S\/VA<\/strong> repr&eacute;sente la participation des salari&eacute;s &agrave; la cr&eacute;ation de richesse de l&rsquo;entreprise, la valeur ajout&eacute;e, c&rsquo;est-&agrave;-dire la marge de l&rsquo;entreprise calcul&eacute;e par le chiffres d&rsquo;affaire moins les achats et prestations pass&eacute;s aux fournisseurs.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">Cependant, il est possible de d&eacute;roger &agrave; cette formule l&eacute;gale si la <a href=\"http:\/\/toutsavoirsurlepargnesalariale.fr\/pee\/index.php\/glossary\/limite-formule-derogatoire\/\" data-type=\"glossary\" data-id=\"456\">formule d&eacute;rogatoire retenue <\/a>est plus avantageuse pour les salari&eacute;s.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-subtle-light-gray-background-color has-background\"><tbody><tr><td>La formule d&eacute;rogatoire est obtenue en assouplissant un des param&egrave;tres de la formule l&eacute;gale ou de modifier certains indicateurs.<\/td><\/tr><\/tbody><\/table><\/figure><p>Le dirigeant a &eacute;galement la possibilit&eacute; de mettre en place, sans accord additionnel, un suppl&eacute;ment de participation.<\/p>\n\n\n\n<div class=\"wp-block-buttons aligncenter\">\n<div class=\"wp-block-button is-style-outline\"><a class=\"wp-block-button__link has-white-background-color has-text-color has-background\" href=\"http:\/\/toutsavoirsurlepargnesalariale.fr\/pee\/index.php\/2020\/07\/20\/supplements-de-participation-et-dinteressement\/\" style=\"border-radius:8px;color:#2a870d\" target=\"_blank\" rel=\"noreferrer noopener\">En savoir plus<\/a><\/div>\n<\/div>\n\n\n\n<h4><span style=\"color:#2a870d;\" class=\"has-inline-color\">II. Cet accord doit g&eacute;n&eacute;ralement &ecirc;tre sign&eacute; dans l&rsquo;ann&eacute;e suivant la cl&ocirc;ture de l&rsquo;exercice au cours duquel il est entr&eacute; en vigueur.<\/li><\/ol><p class=\"has-black-color has-text-color\">2. L&rsquo;accord doit <strong>&ecirc;tre d&eacute;pos&eacute; &agrave; la <\/strong><a href=\"http:\/\/toutsavoirsurlepargnesalariale.fr\/pee\/index.php\/glossary\/direccte\/\" data-type=\"glossary\" data-id=\"458\"><strong>DIRECCTE<\/strong> <\/a>afin de donner droit &agrave; l&rsquo;exon&eacute;ration de charges sociales et fiscales et &ecirc;tre en mesure de proc&eacute;der aux versements des primes.<\/p>\n\n\n\n<div class=\"wp-block-group\"><div class=\"wp-block-group__inner-container\">\n<p>3.
